Product Warranty

Capgo Pty Ltd warrants to the customer that (i) all products (excluding software) will be free from defects in material and workmanship under normal use and service, and that software products will be free of serious defects (bugs) and will function as indicated in sales literature, for a period of one year from the date of invoice. Customer's exclusive remedy for breach of this warranty is that Capgo Pty Ltd will either

  • Repair or replace, at its option, any product which fails during the warranty period because of such defect (if customer promptly reported the failure to Capgo Pty Ltd in writing) or,
  • If Capgo Pty Ltd is unable to repair or replace, Capgo Pty Ltd will refund the purchase price of the product upon its return to Capgo Pty Ltd.

This warranty does not apply to any product which has been subjected to misuse, abnormal service or handling, or which has been altered or modified in design or construction, or which has been serviced or repaired by anyone other than Capgo Pty Ltd. The warranties set forth herein are in lieu of, and exclusive of, all other warranties express or implied.

Life Support and Safety Policy

Capgo's products, both hardware and software, are not authorized for use as critical components in life support systems, or in critical systems without the express written approval of a public officer of Capgo Pty Ltd. Capgo Pty Ltd will not knowingly sell its products for use in such applications unless it receives an adequate "products liability indemnification insurance agreement."

For the purposes of this document:

  • Life support systems are devices or systems which support or sustain life and whose failure to perform when properly used in accordance with instructions for use provided in the labeling can be reasonably expected to result in a significant injury or loss of life.
  • A critical component is any component in a life support device or system whose failure to perform can be reasonably expected to cause the failure of the life support device or system or to affect its safety or effectiveness.
  • A critical system is any system whose failure can be reasonably expected to result in a significant injury or loss of life.

Constant Improvement - Right to Change Without Notice

Capgo strives for constant improvement in its products and services. As a result Capgo reserves the right to make changes in the products and services at any time without notice in order to improve the products or services.
